A trust is a legal way to protect  your property, money, and investments. When you place assets into a trust, Trustees are appointed to manage them according to your wishes, either during your lifetime or after your death. Trusts are often used to support those who may not be able to manage their own assets, for example; minor children, vulnerable individuals or people with disabilities.

We know that everyone’s financial and family situation is different. That’s why we take the time get to know you and your family and understand your needs.  We then create a tailored plan that works for you now and in the future.

Request a consultation with our expert trust lawyers to discuss how you can set up a trust to protect and manage your wealth for the future.

There are 4 different types of trusts

    Will trusts

    For protecting assets after death

    • Created through a Will and comes into effect after you pass away.
    • Useful for ensuring assets go to the right people and protecting beneficiaries (e.g., young children). Used to control assets post death for multi generations

    Life interest trusts

For providing income to a loved one while protecting the capital

    • Allows someone (e.g., a spouse) to benefit from income or live in a property for life.
    • The capital or property is then passed to other beneficiaries (e.g., children) after their death.
    • Ideal for married couples or families with children from previous relationships. Can help with care home fee protection

    Lifetime settlements

For managing assets while you’re alive

    • Set up during your lifetime to protect assets, often from second marriages, care home fees and to mitigate inheritance tax.
    • Can help avoid probate and ensure a smoother transfer of wealth.
    • Suitable for those who want long-term financial planning and control.

    Compensation protection trusts

    For protecting compensation payouts

    • Used when someone receives a large compensation payment (e.g., from an injury claim).
    • Helps benefits eligibility.
    • Management of monies when a person lacks the capacity to do so themselves
    • Ideal for vulnerable individuals or those who need long-term financial security.

Our STEP-qualified lawyers can help you set up the right trust, advise trustees on their responsibilities, explain how trusts are managed, and provide detailed tax advice. With extensive experience in Wills, estate planning, probate, and tax law, we’re here to make the process as straightforward as possible.

    Why Trusts are important?

Protect Your Assets – A trust helps safeguard your wealth, property, and investments from risks such as divorce, creditors, or poor financial decisions.

Control Over Your Wealth – You decide how and when your money and assets are used, even after your lifetime. This is particularly useful for young beneficiaries or those who may need guidance.

Reduce Inheritance Tax – Certain types of trusts can help mitigate inheritance tax, ensuring that more of your wealth is passed on to your loved ones.

Avoid Probate Delays – Trusts allow assets to be transferred more smoothly after death, avoiding the probate processes.

Provide for Vulnerable or Disabled Family Members – A trust can ensure financial support for a loved one without affecting their eligibility for state benefits.

Protect Against Care Home FeesSome trusts can help protect your home and assets from being used to cover long-term care costs.

Keep Family Wealth in the Right Hands Trusts can prevent assets from falling into the wrong hands, such as in the event of remarriage or family disputes.

Flexibility for Life ChangesMany trusts can be adjusted over time to suit changing circumstances, such as marriage, divorce, or financial growth.

ConfidentialityUnlike a Will, which becomes a public document once probate is granted, a trust remains a private documents, keeping your financial affairs confidential.

Peace of MindSetting up a trust ensures your loved ones are looked after according to your wishes, providing long-term financial security.
