Transfer of Equity

Transfer of equity refers to the legal process of removing or adding someone to the title deeds (ownership) of the property.

First Registrations

When a property has never been registered with the HM Land Registry, there will be a bundle of original deeds still in existence. These deeds will either be held by the mortgage company or the property owner.

The process of first registration involves submitting an application to the Land Registry. Once approved, the relevant details are held in the Land Registry’s database, the details of which can be reviewed online, and thus negating the requirement for the original deeds bundle.

Mortgage and Re-mortgage

Private Mortgages and Loans

We are able to act for you in relation to a private loan to be secured against your or another party’s property.

One scenario where this might be applicable is where a parent is able to loan their adult child the funds to purchase a property as an alternative to a traditional mortgage. Another might be where a Director of a company wants to secure a loan provided by them to their limited company for a property purchase.

We can assist with simple charges to secure a financial interest or with more complex loan agreements in partnership with our Commercial team.

What is a re-mortgage

A re-mortgage occurs when you pay off one mortgage with proceeds from another replacement mortgage.

There are many reasons why you would want to switch mortgages. However, the most common ones are to obtain a more favourable interest rate from a different lender, to extend the term of your mortgage with a different lender or to release some of the equity in your property.

If you are simply switching from one type of mortgage to another but remaining with the same lender then this is not a re-mortgage and it can usually be dealt with by the lender themselves without a solicitor being involved.

Declaration of Trust

A Declaration of Trust is a legal document which records the financial arrangement between co-owners of a property.

Buying a plot of land

Buying a piece of land can be a major investment so it is important to understand exactly what you are buying and its potential for future uses.

We can assist with the following:

  • Buying a plot of land next to your home
  • Buying a plot of land to build a house on
  • Buying a plot of land to keep livestock or horses

You will need to understand if any rights (such as sporting rights) are specifically excluded from the land sale or, within the title deeds, which could affect your future use and enjoyment of it.

Jonathan is a Partner in mlplaw’s Real Estate team with over 13 years’ experience in real estate transactions.  Prior to joining mlplaw, Jonathan was a partner in a long-established local law firm in Manchester for over a decade.

Jonathan has extensive knowledge and experience in dealing with both commercial and residential property matters.  His main expertise is in relation to commercial landlord and tenant matters (acting for both landlords and tenants), commercial property acquisitions and disposals (acting for both sellers and buyers), real estate aspects of real estate finance (acting for both borrowers and lenders) and corporate support.

Jonathan acts for a wide range of businesses and individuals including sole traders, SMEs, property investors, pension funds and property developers in the retail and wholesale, hospitality and leisure, food and beverage and industrial and office sectors.  Jonathan transacts properties in locations throughout the North West and nationwide.

Chloe Linsley

Trainee Solicitor - Property

Chloe completed her Undergraduate Law Degree at the University of Chester prior to going on to complete her Postgraduate LPC and Masters in Law at the University of Sunderland. She then joined a growing, mid-size firm in Stockport as a paralegal specialising in residential property. Chloe instantly took on her own caseload and it was from this first role that she discovered her particular interest in property law, particularly residential property.

Chloe has experience in acting for both private individuals, first time buyers and companies. She has developed her knowledge and experience in many areas such as freehold, leasehold, shared ownership and right to buy.

Chloe is keen to develop her skills and expand her knowledge working closely with senior members of the Residential Property team at mlpaw, with the ambitious goal to eventually qualify as a solicitor.

In her spare time, Chloe enjoys spending time with her friends and family, going on hikes, trying new restaurants and going to the theatre.

Victoria Hands

Conveyancing Executive

Since joining the Conveyancing Industry in 2010, Victoria has become an experienced Residential Conveyancer.

Victoria has studied part-time in order to obtain her Level 6 Diploma in Law and Practice and soon hopes to qualify as a Legal Executive.

In 2017, Victoria won the LFS Young Conveyancer of the Year Award.

On a day to day basis, Victoria assists clients by offering thorough and practical conveyancing advice and, as she is aware of the many issues faced by clients when moving home, she is able to deliver a personal and empathetic service.

During her spare time, Victoria enjoys the great outdoors and touring around the country in her VW camper van with her husband and young daughter.
